Although the contributions that two people make towards making a marriage work may be equitable-their financial contributions may not be equal. Because of this, judges will often order one spouse to pay alimony (spousal support) to the other on either a temporary or permanent basis as part of a divorce settlement. Alimony is not intended as a punishment for the spouse who pays or a reward to the spouse who receives; rather, alimony is intended provide the means necessary for the spouse who receives it to become self-sufficient.

Specific factors that can affect whether or not alimony is ordered in your case, and if so, whether it will be permanent support, rehabilitative support, limited duration support, or reimbursement, include:

  • The length of the marriage
  • The relative income and/or earning capacity of each spouse
  • The relative age and health of each spouse
  • The marital standard of living (lifestyle)
  • Contributions made by one spouse to the earning capacity of the other - this can include cases where one spouse worked to put the other through college or professional school
  • The complete list of factors considered in determining alimony can be found in NJSA 2A:34-23(b).
